Comment: A highly recommended litigation and arbitration practice whose team recently grew esp. in Munich. Not only was a product liability expert appointed partner, a compliance counsel and an extended associate tier also gave the practice a boost. It is remarkable to see just how firmly positioned the team has become e.g. among DAX corporations. BASF added the firm to its global advisor list and it was also called upon by major banks, partly thanks to Witte’s know-how in D&O liability cases. Haß is representing Daimler and VW in prominent disputes with supplier Prevent. The product liability team based in Munich is a powerhouse for the practice and one of the leading players in pioneering topics such as driverless vehicles, thanks primarily to its profound knowledge of the automotive sector and its regulatory requirements. In this regard, younger partners have quickly established themselves next to Brock, who recently won significant proceedings for Tüv Rheinland before the European Court of Justice and the German Federal Court of Justice in connection with breast implants. Lawyers holding positions below partner level are also regularly noticed by competitors, which testifies to the firm’s positive promotion of up-and-coming talent. This may well facilitate further growth in the arbitration practice, which is very much centered around reputable lawyer Pörnbacher.
Strengths: International product liability practice.
Development potential: Competitors such as Allen & Overy and Latham are more visible in financial market disputes. It could be well worth strengthening this area, e.g. with a lateral entrant in Frankfurt, in order to better align the international practice and increase the firm’s strength in liability matters.
Recommended: Dr. Detlef Haß (“good at recognizing the essence of a matter”, competitor), Karl Pörnbacher (“hugely experienced, really knows his stuff”, “unconventional, precise, quick – practically in a league of his own”, competitors), Ina Brock (product liability), Dr. Jürgen Witte (“competent, pragmatic, sound judgement”, “effective, no airs and graces”, clients; D&O coverage and liability), Dr. Sebastian Lach (“structured, friendly, strong-willed”, competitor; compliance and product liability).
Practice: ?Corporate litigation and disputes in the plant construction and ?real estate sectors, increasingly also ?antitrust disputes. Frequent involvement in ?insolvency-related disputes. ?Compliance advice. Arbitration work as litigator or arbitrator. Broad spectrum in product liability. (10 partners, 6 counsel, 43 associates, 3 of counsel, plus project lawyers)
Clients: ?? VW and Daimler in lawsuits against Prevent Group supplier; Air Canada on defense against damages in air freight cartel; Ford on assertion of damages against various supplier cartels; Tüv Rheinland on international defense against claims concerning P.I.P. silicone implants; regular advice on product liability to Merck & Co.
