BIRD & BIRD

Comment: This firm is highly recommended in trademarks and unfair competition and has a broad and notable client base, for whom it frequently litigates in complex disputes. B&B brought this strength into play for Anson’s in the long-running trademark dispute with Asos. Work often has an international flavor and B&B is well positioned with its international background. The practice litigated, for instance, for a well-known software manufacturer before the Federal Court of Justice (Bundesgerichtshof) and represents clients like Audi and L’Oréal on an ongoing basis. Advice to Deutsche Telekom is not registered as strongly. The Hamburg office, a pivotal location for stand-alone IP, is still without a partner, but is served by the other offices. The Frankfurt practice was bolstered, however, with new partner Dr. Niels Lutzhöft from Geiss Lutz.
Strengths: Trademark strategy advice, litigation (incl. in connection with color trademarks).
Recommended: Dr. Joseph Fesenmair (“always a good contact”, client; “esp. skilled and experienced in trademarks and licensing”, competitor), Dr. Uwe Lüken (“very pleasant to work with”, client), Dr. Markus Körner (“very pleasant and competent”, “outstanding negotiator and excellent jurist”, competitors), Dr. Susanne Koch, Dr. Richard Dissmann (“very professional and precise”, competitor).
Practice: All-round advice to large companies on the development of trademark strategies and litigation in trademark infringement proceedings. Also formal trademark law. In unfair competition, litigation and strategic advice. (6 equity partners, 6 counsel, 16 associates)
