KLAKA

Comment: A highly recommended firm in trademarks and unfair competition which one competitor described as “a big hitter in IP”. The boutique is chiefly active in litigation for regular clients, e.g. for BMW in a series of trademark and design disputes and for Longchamp in trademarks and unfair competition. Klaka widened its activity in unfair competition too: a partner from patents is increasingly supporting the team and litigated for the Center for Protection against Unfair Competition up to the Federal Court of Justice (Bundesgerichtshof). There was a rise in work on the interface with food law, evidenced by new trademark and unfair competition proceedings for Nestlé. A partner appointed last year is gradually taking over work from Nieder, who took up of counsel status.
Strengths: Litigation.
Recommended: Dr. Michael Nieder, Dr. Andreas Schulz, Dr. Ralf Hackbarth (“very competent, quick to react and proactive”, client), Dr. Wolfgang Straub, Dr. Wolfgang Götz (“outstanding litigator”, competitor), Dr. Stefan Eck, Dr. Stefan Abel (“competent and in tune with practice”, competitor), Oliver Rauscher (“highly experienced trademark lawyer with wit and intelligence”, competitor).
Practice: Trademark advice and litigation as well as an all-round registration and administration practice (esp. for fashion houses and banks). In unfair competition, litigation predominates, frequently on the interface with food law, copyrights and pharma advertising law. Renowned ?patent litigation practice. (10 partners, 5 associates, 1 of counsel)
Clients: ?? Litigation for BMW, incl. series of proceedings concerning “M”; trademark infringement litigation for Rolls-Royce; Longchamp on design protection, trademarks and unfair competition; Center for Protection against Unfair Competition on unfair competition; trademark and design registration and litigation before EUIPO for Deichmann.
