FRESHFIELDS BRUCKHAUS DERINGER

Comment: This leading firm for corporate litigation boasts a particularly comprehensive and large-scale litigation practice. Besides accompanying sensitive AGMs, often associated with special topics, new challenges posed by active shareholders following the US example has also been high up on the agenda of late. The case of Stada was a novelty in this regard as the shareholder managed to force the restaffing of the supervisory board. Seibt has built up specialist expertise here which were quickly called upon also in completely different cases. FBD is above all, however, one of the first port of calls when it comes to D&O liability matters as it not only has top-class contacts in the German corporate world, much like Hengeler, but it also gets a lot more from its internal connections than the majority of its competitors. In advice on D&O liability, for instance, intensified sanctions regimes also play a role in capital markets, antitrust, tax, data protection and consumer law – topics for which, unlike other leaner outfits, FBD has a number of experts at its fingertips.
Strengths: Excellent stock corporation law and capital markets practice; highly integrated interoffice cooperation, esp. with litigators ( ?commercial litigation and liability); corporate valuation (in the context of shareholder disputes); proceedings with an international element.
