NOERR

Comment: A highly recommended firm for energy law which is constantly winning clients and branching into new fields of advice, thanks to the partners capitalizing on their energy sector contacts. Regulatory lawyer Kermel proved a pivotal link to the sector when it comes to compliance advice. While erstwhile top dogs like Freshfields are shrinking, Noerr is looking to increase advice in traditional energy and regulatory law. The main highlight was advice to the Federal Ministry of Economics on negotiations with RWE, E.on and others regarding the nuclear energy fund – a complex and lengthy instruction at both regulatory and funds law level, which Noerr obtained thanks to Schmitz’ public law practice. This is often seen in advice to ministries and authorities. But the core field of activity is still transactions in the energy sector: Noerr advised ISS Facility Services on taking over Evantec and Veolia Industrial Services on the sale of Vattenfall’s Nuon Energy and Service. Dr. Tom Beckerhoff, an accomplished project finance lawyer, brought experience in the energy sector from Ashurst, which should lead to growth in finance work.
Development potential: Noerr has taken an aggressive approach in recent years to secure its slice of the pie, and now needs to continue this in its new Hamburg office to market its existing offshore expertise more effectively.
Recommended: Dr. Cornelia Kermel, Christof Federwisch.
Practice: Broad team, advice on M&A and PE transactions, contracts, projects and project finance, esp. in renewable energies (incl. accounting and tax advisory know-how), also regulatory advice on energy law. Strength in construction and environmental law. (8 equity partners, 10 salary partners, 7 associates)
Clients: ?? Federal Ministry of Economics on negotiations for financing nuclear power plant dismantling and nuclear waste disposal; European Investment Bank on financing renewable energies, incl. offshore wind farm Butendiek; ISS Facility Services on Evantec takeover; Veolia Industrial Services on sale of Vattenfall’s Nuon Energy and Service; EWE Netz concerning requirements for existence of off-peak tariff (Oldenburg Regional Court (Landgericht) and Celle Higher Regional Court (Oberlandesgericht)).
