LUTHER

Comment: Luther comes highly recommended in energy law and is very active in the market, often snatching work away from the competition: it replaced FBD as advisor to E.on for many issues. The Düsseldorf team is pressing ahead with the expansion of work, successfully following the current trend of stepping up advice on energy sector JVs. Luther was also involved in complex takeovers like the Jordgas transaction for OGE. Besides the extensive regulatory know-how of Stappert and Jansen, the arbitration practice, esp. Dr. Richard Happ, stands out. He handled the ICSID proceedings for Vattenfall (public knowledge) and many more of these very lucrative instructions from the energy sector.
Strengths: Strong litigation expertise and operational energy sector know-how. Luther also advises numerous industrial companies on state aid law in connection with the Renewable Energies Act 2012 exemptions.
Recommended: Dr. Holger Stappert (“expertise and value for money”, client), Dr. Stefan Altenschmidt, Dr. Guido Jansen, Dr. Stefan Kobes.
Practice: Transactions and project work, also emissions and energy trading. Energy contracts and regulatory issues (esp. access regulations and network charges), as well as unbundling and ?antitrust. Clients: large energy utilities, TSOs, public utilities and investors. (16 partners, 3 counsel, 24 associates)

Eneco regarding shareholding in Lichtblick; Open Grid Europe on takeover of Jordgas Transport from Statoil with Gasunie Deutschland; Vattenfall in ICSID arbitration proceedings against German federal government regarding nuclear phase-out; German energy utility on restructuring regional energy utility; company from the nuclear industry on nuclear energy law and construction.
