EVERSHEDS SUTHERLAND

Comment: A firm respected for trademarks and unfair competition which can rely on a solid Mittelstand client base but is benefiting more and more from its international setup. Close cooperation with the French office gave rise to key IP clients last year, e.g. Kering, and ties to the UK practice have now been tightened: work for Avon Cosmetics gained momentum, with the German IP lawyers even steering the international instruction. “Very good project management skills and thus well suited to multijurisdictional projects,” praised a client. ES also built on activity for pharma companies like Aspen or Otsuka. This success was reflected in personnel strategy: the practice, which is concentrated in Munich, grew by several associates.
Development potential: A young Munich partner is set to build a bridge between the trademark practice and the US, as the Sutherland part, which came on board in early 2017, offers many opportunities with its broad IP setup. If this succeeds, other lawyers will have a chance to carve out a profile. Market visibility remains limited to senior partner Zimmermann.
Recommended: Axel Zimmermann (“experienced and pragmatic”, competitor).
Practice: Alongside trademark advice and licensing contracts, litigation activity related to IT, copyrights and design law. Frequent work for media companies (incl. right of reply) and advertising agencies in IP. In unfair competition, often litigation in connection with employee poaching and work for pharmaceuticals companies in pharma advertising law. (1 equity partner, 4 salary partners, 13 associates)

All-round IP activity for Avon Cosmetics, Avis and Kering/Gucci; all-round litigation in pharma advertising law for Aspen; Otsuka Pharmaceuticals on trademark licenses; trademark, design and unfair competition litigation for TSI; Starbucks on product launch; ongoing activity for Odeon Film, Pentair, For Sale Group, Tele Munich, Resysta, Lambert, Wolford.
