Comment: A recommended firm for trademarks and unfair competition which is widening its practice and developing very positively, esp. at its youngest IP office in Cologne. Here, trademark infringement litigation was conducted for auto dealer Berten Cars and a large discount store. The partners also won new clients at the traditionally strong Freiburg office, among them a tool manufacturer for unfair competition and design law, and built on high-profile instructions. FGvW litigated for long-time client Wilkinson against Beiersdorf regarding misleading advertising. The fact that FGvW bolstered IP even at the small Frankfurt office with Stephan Dittl (from Salger) highlights the importance of soft IP for the whole firm. It will now have to show that interoffice cooperation works within the practice and on an interdisciplinary level.
Strengths: Formal trademark law, advice to the pharmaceuticals, pharmacy and publishing sectors.
Recommended: Norbert Hebeis (“visible in litigation, always good”, competitor), Dr. Wolfgang Schmid , Dr. Hans-Georg Riegger, Dr. Morton Douglas.
Practice: All-round advice on trademarks incl. portfolio management. In unfair competition, work frequently related to pharma advertising law, esp. in advice to large pharmaceuticals clients. Other sectors include pharmacies, consumer goods, food, energy and publishing (often in copyrights). Office in Alicante. (4 partners, 1 local partner, 5 associates, 1 of counsel)
Clients: ?? Trademark infringement litigation for Berten Cars; ongoing advice to and litigation for J.W. Ostendorf; all-round IP activity for Wilkinson Sword, incl. trademark administration and litigation against Beiersdorf; tool manufacturer on unfair competition and design law; trademark infringement litigation for discount store; various pharmacies on unfair competition.
