King & Spalding

Comment: This respected arbitration and litigation practice headed up by Schäfer is known in particular for investment protection proceedings. In recent years, however, it has reached a new phase of development, as reflected in the expansion of the associate level. Although the firm’s representation of Porsche in a settlement with US authorities concerning the diesel scandal was managed from Washington, the German practice played an important role, esp. when it came to drawing up and accompanying the internal investigation in accordance with German data protection law. This demonstrated just how much power this manageable team is able to wield through its close integration in the international network. Even after the US settlement, the practice continued to focus on the topic of emissions, hence expanding its knowledge in environmental litigation with an experienced associate who is making the move from Austin to Frankfurt. Business is otherwise dominated by arbitration proceedings: Schäfer is much more active in the role of arbitrator than many competitors and was therefore able to significantly increase K&S’ visibility.
Strengths: Experienced in investment protection, close international integration.
Recommended: Jan Schäfer (“internationally experienced, good negotiation skills”, competitor).
Practice: Commercial and distribution litigation; litigator and arbitrator in post-M&A and commercial law disputes. Also investment protection (usually with US offices and Paris); sectors: energy, plant construction, automotive. Increasingly compliance, esp. concerning data protection. (1 partner, 4 associates)
Clients: ?? Porsche AG in investigation conducted by US authorities in connection with diesel scandal; ICSID proceedings concerning solar subsidies on behalf of KS/TLS Invest and Matthias Kruck against Spain, ESPF/Infraclass and VC Holding against Italy; Korean corporation in ICC proceedings against companies in Egypt and Kuwait.
