ALLEN & OVERY

Comment: A highly recommended firm for energy law which, in this sector too, is visible for its typical strengths in M&A and finance, and often seen working for banks in the financing/refinancing of renewable energy projects. Dr. Peter Stenz and Dr. Norbert Wiederholt’s finance team was active in a series of wind farm financing projects in France, Finland and Canada. Hamburg partner Dr. Nicolaus Ascherfeld handled one of the biggest projects in Germany for Deme related to Merkur wind farm. A&O’s litigation practice tends to operate under the radar on high-volume arbitration cases. There was a rise in energy law proceedings, esp. investment protection proceedings arising from the Energy Charter Treaty. The public lawyers advised on transactions and a number of tenders for gas and electricity grid franchises as well as energy law disputes. But their profile is lower than competitors such as CMS and Freshfields.
Practice: Project finance for banks, investors and project developers; strong banking practice, incl. for ?debt issues and structured finance and renewable energies, increasingly litigation (esp. arbitration). Public procurement in relation to the awarding of franchises. (Core team: 6 partners, 2 counsel)
Clients: ?? Deme on acquisition, construction and financing of offshore wind farm Merkur; Norddeutsche Landesbank Girozentrale on refinancing solar farm Finsterwalde II and III; Landesbank Hessen-Thüringen Girozentrale on financing Kraftwerke Mainz-Wiesbaden; bank consortium on financing Küstenkraftwerk K.I.E.L.; global petroleum corporate on dissolving JV and acquisition of various refinery holdings.
